State Specific Question About: MINNESOTA (MN)

Please help!

What can I do?

On Aug. 27, 2009. A couple signed a lease to rent starting Aug. 29, 2009. A 3 bd SFH.

They wrote a check for $658 which was for the rent of Sept. and the rent for Aug. 29-31. Written into the contract..... the sec. dep. was to be paid half on Sept. 7th ($325) and the other half on Oct. 7th ($325).

Yesterday, I got a letter from my bank stating the check was "RETURNED FOR INSUFFICIENT FUNDS".

The husband called me after being in the house for 2 days telling me my yard had holes in it, the house had all kinds of problems and threatening to not pay rent until everything was fixed.

Just so you know this house was practially rebuilt in 2004 and never had any of the previous 10 renters ever had a problem with the house. I checked out the issues he talked about, the only thing that was an issue was a soft floor under the toilet. How 3/4" green treated plywood (new in 2004) rots out so fast is beyond me. I am currently replacing the floor and installing a new toilet.

Now, I have renters that are complainers in the house, that are looking for reasons not to pay me. They have been in there since Aug. 29th, I have a bounced check here. I have NO money from them.

What can I do to get them out of there FAST? Does it have to be a 30 day notice? Since I have not received a dime from them? What would be reason for eviction? Eviction due to nonpayment, I would assume but any way to get them out quicker then 30 days?

please help

There is a lot of construction crews in town that need a place to live and I want to get these dead beat complainers out of the house so I can get a good paying renter in there.

Brian and Tyler are right Joe; apparently you've let them in with no money and they cannot pay even if they want too. Don't feel bad, I could have done the same thing a few years ago had it not been for reading on this board. I had two accepted applicants in a row give me bogus personal checks, which I still happily accept for move-in money. But the difference is I take their check directly to their bank to cash before handing over the keys.

One of those folks did not even have enough in the account to "cash a $5 check!" I think the amount was around $1200. But I want to know if a new tenant is capable of bouncing a check and what better time than just before they're moving into my property. Here, they can be locked up for writing bad checks, hopefully someone from MN will post later with options for your situation. --67.166.xxx.xx

well it was just a matter of time. You took the first months rent and deposit in the form of a personal check-- lucky it hasn't happened to you before.

Look up your state law concerning NSF's.

In GA you must send the issuer a letter certified and regular mail to make the check # ***** in the amount of ****** payed to the order of ******-- then go and get the warrent for the bad check. Start the court action asap for non pay of rent.

find out if this nsf qualifies for a felony warrent--- here if it's over a certain amount it's a felony. --74.184.xxx.xx

If it's a crime to write bad check in Min ( it's not in Kansas ) I'd be down at the DA's office 1st thing Tuesday Morning. In the mean time giving you a worthless check is same as not paying you Give them 3 day or Quit Today. This is a classic case. You gotta do a lot more than just evict.

You asking means you probably need an eviction law firm which will handle all the serving & other work. The serving may cost an additional $ 50 but I would want this handled professionally!

Now call your D.A.'s Bad check Restitution Hotline. Press criminal charges and maybe re-deposit that check. It was sent to you?

Call tenant's bank and in casethere are sufficient funds near pay day, drive there and deposit that check again!!

Tell me you verified and copied government ID and ran a credit check?

Here is your homework, read 100 posts about screening.

Closing, the worst thing you can do is waste more time. Make that call, even if that means eating Rahmen Soup for a week or two. Such tenants tend to PROMISE a lot and gullible landlords fall for their lies. We will be out by XY. Or they break things, then call Code Enforcement.

Please explain why you were so desperate as to take someone who could not come up with any s.d.! You have a good house. Maybe the price was too high?

How do you advertize?

How do you screen applicants and verify their income, credit and tenant history?

The sc*oundrel is likely a pro who specializes in ripping off decent and trusting landlords. Such a person has no credit = trust left, so they stopped caring.

That guy knew there wouldn't be funds to cover that check when he wrote it! (I had both, rent and s.d. checks written on a closed account).

You are hurting and fuming, but all this probing is necessary. It's all about learning from this horrific experience and to avoid a reoccurance. --125.25.xx.xxx

For some strange reason in Kansas if you write a bad check for a carton of cigarettes you go to jail However if you write a bad check for rent it's not a criminal offense and the LL's only recourse is through the civil courts. Had one like this, when I was naive and didn't know any better. NO personal checks on move in money, unless they are willing to wait for the check to clear before I give them the keys. I would consider them professional renters if they are already complaining 2 days after moving in. They knew full well they did not have the funds in the bank. I would give them 24 hours to make the check good and when they don't take it on to the magistrate, plus go ahead and file eviction for non-payment.
