State Specific Question About: VIRGINIA (VA)

I am a new landlord. My resident has not paid rent that was due on the 25th of Aug. I was told that the rent was sent in the mail which I don't believe. My question is can I use the security deposit now for rent? The security deposit does not quite cover the entire amount but I do have noterized co-signers for this resident. How can I have them be responsible without going through costly legal means? Just starting out, I didn't want to start spending money like this already. --96.225.xxx.xxx

No do not use SD towards rent until the they are out. Call send 3 Day Notice and call cosigner. Don't hestitate to file if necessary. Lost in the mail is not your problem. Late fees need to be included to avoid filing. --99.177.xx.xx

VA is cheap. Nothing costly about eviction other than the loss of rent and clean up. Send out your 5 day notice. If they don't pay up, get back to us and we'll give you the next step.

Welcome! I'm in Chesapeake as well. My properties are in Norfolk and Va. Beach. First thing you gotta do is send out your 5 day notice. Do that immediatly. I'd also send one to the co-signer as well. Forget about the security deposit for the time being. It's not intended for rent. Lets hope this doesn't go to court, but your luck in that VA is LL friendly. Court cost if need be will run about $53.00 for one defendent and around $12.00 per additional defendent. You can do this yourself, no lawyer needed. If it comes down to it, I would be happy to meet with you and "hold your hand" for the first go around. That is provided your female. DH wouldn't be happy about me meeting up with a guy.
