State Specific Question About: IDAHO (ID)
I discovered my tenets two sons are smoking in the garage. The tenet misled me and said no one in the house smoked then finally admitted it after cigarette buts were discovered. There is a no smoking clause in the contract. So do I evict them or tell them to only smoke outside. I'm not teenage boys will abide by the rules. I am worried they will smoke inside once the weather gets cold. This house is recently remodelled and we have thousands into it. Please help with some advice

Do parents know kids are smoking? I'd tell mom and dad and explain to them they could lose the house if the kids keep this up. Also in most states now tobacco possesion by minors is illegal . They have actually arrested kids around here for smoking in public. --70.250.xxx.xxx |

Smokers are addicts. If they're already smoking in the house, they're not going to stop. If you want to stop the smoking, you will have to evict them. Also, since you're in a cold climate, it's very unlikely they will smoke outside in the winter. --70.143.xx.xxx |

CDM you're right about the addiction . i've known so many people who smoked and then had a baby . When bundle of joy first came home they made big deal about not smoking in the house with baby. three months later they're dropping ashes on kid while smoking with one hand and trying to change diaper with the other. If the garage has unpainted sheetrock and an unsealed concrete floor, you are going to have to do some major work to get rid of the smell - happened to us. Also, they WILL smoke inside during the bad weather - usually in the bathroom with the exhaust fan on. Great fun when you're trying to repaint, as the nicotine sticks to the paint - need to clean with TSP first.

Do monthly inspections and tilt picture frames, then you will know how much smoking has already been in the house, adjust next month rent with repainting estimates to keep unit appearing smoke free, they will get the message thru the wallet/s. --76.241.xxx.xx |

Not your problem the kids are smoking underage. You may mention it to the parents, but only as a reminder no smoking in the house, not to tattle on the kids.

I think it IS your problem that your tenants are breaking the law in your rental and you know it.
I would send a Demand letter to the tenants (before a Notice to Cure or Quit) indicating that all smoking must cease on the NONsmoking property that you rented to these tenants immediately or legal action will follow.
Then you have to check. Teen boys are not going to care, but I wouldn't let them discard their butts all over and maybe start a fire. I'd get rid of them. --65.55.xx.xxx |
