State Specific Question About: MISSOURI (MO)

I have an neighbor who applied for a variance to the current p & z regulations in order to build a garage. This will encroach on the front & side set back rules outlined by the p & z regulations. There will be a meeting at city hall to discuss plans and hear from any concerned neighbors. I am opposed to this for many reasons, but mainly because i purchased this property with the intention of eventually moving into down the road. The garage will set ahead of their house & will visually be and eye sore. It will change the aesthetics of the property layout, restrict views out the south corner of my house, etc. Has anyone had experience in fighting such matters? --24.107.xx.xx

No experience Mike..but can you take and presents enlarged photos to present how and why you feel infringed on before you appear and testify?

I take it that the people who want a garage where there first ? You then are the Auslander? You might consider the possibility that these people and others that were already in the neighborhood will harbor rsentment and hostility that will last for sometime and could cause you grief for years to come. I have a friend that requested a variance to build a carport for the van for his disabled son. The board told him he had a chance as long as none of the neighbors raised a concern. I would suspect that if you made the case that it would be an eyesore and there were not extenuating circumstances (boards are swayed by requests from disabled) you have a good chance of having them deny the variance. --69.154.xxx.xx

Our board will hear objections at open meetings, but that means I have to remember to go and sit through 3 hours.

I learned my lesson: they read the letters they recieve aloud at the meeting. they also read these BEFORE the meeting and talk to each other. The REAL decisions are made before they walk in.

Now, I send a calm, reasonable letter and explain that "while I still want to be friends with my neighbors (like Reid said) I have a legitimate concern with the request as do others who may not speak up and would ask it be denied in it's current state. Perhaps it can be re-arranged to make more neighbors happy and be consistent with the neighborhood."

Our committee uses buzzwords like "consistent", "best use", "non-infringing", "non-interfering". I like to use their vocabulary.

The property i purchased has actually been in the family or over 30+yrs. I bought due to unfortunate financial issue. The neighbor has been there for 10yrs. Only after i asked him to move his boat off my property is when this all began. Retribution is the underlying factor here in my opinion. Have not yet personally met the man yet, his wife was the one outside when i cordially asked for them to move their boat for liability reasons... --24.107.xx.xx

Mike, two things will win for you.

1) A lawyer

2) computer graffic pictures of the loss of your view.

3) use of the buzz words, "interfering with my quiet enjoyment" "safety issues"...cannot see around their garage for driving "community eyesore" etc. A lawyer will know the correct terms --70.179.xx.xxx

There ya Go, Hope this doesn't turn into a Hatfield and Mccoy thing for you . i guess I always just expect the worst. I had a place that had an easement so backyard garage could be acessed from behind . Then a fella bought property behind my rental and blocked drive with cement barricade, City PD had to keep having him move it trying to explain to him what an easement was. Well he finally gave up on that and then tried to sue me because the sewer line from one of my other houses hooked into the main line that ran through the edge of his property. well after a year of legal fees and having atty's prolonging things till judge finally said put up or shut up the suit was dropped , Sewer line had been there since the end of WW2, But that's why i mentioned someone getting a burr under their saddle. In my experience on the other side of the state, objections from neighbors have a strong impact on the persons who decide. On the other hand, lack of objections or even better - actual support - will help something be passed.

I expect that a reasoned objection from you with documentation sent in advance of the actual hearing as well as showing up for the hearing and asking to speak would make a big difference in the outcome.

When I had a next door neighbor who needed a variance to the setback to add on a room, before they turned in the request they came calling on all of us that were near their property to explain what they wanted to do and find out if we had any concerns. That kind of advance work helped prepare their case for smooth sailing.

They did something similar for a variance on another issue which was somewhat more controversial, and this time they asked if neighbors would be willing to sign a statement of support.

On the other hand, a person on a nearby block built a fence in violation of local law, with no request for a variance. After neighbors complained, he then filed for a variance. The neighbors continued to vigorously complain, and eventually he had to tear down part of fence in order to make significant modifications to get approval. --205.188.xxx.xx

I will keep it short. To make things like this successful, the most important work is done well before the meeting. 90% of the decision will have been made days before the meeting.
