State Specific Question About: MISSISSIPPI (MS)

if someone pays rent one day for an entire month then decides that night they want their money back for rent, when the deposit was paid a week in advance to hold house until they paid rent on that day stopping any chance of renting to someone else, am i leagally responsible to give them their rent money back? --70.157.xx.xxx

You do NOT collect a deposit to hold a house. You collect a "NON-REFUNDABLE HOLDING FEE", which converts to a deposit at move in time when the rest of the money is paid. Fee is the key word here. A deposit is refundable (example, if they want to back out, like they did). A fee is not refundable.

You may very well be legally required to give them a refund --66.228.xxx.xx

I never take a holding fee, only signed lease, first/last/security, utilities deposit.

Reason being if you negotiate terms with them, they give the deposit(or fee) and they do not want it because of "verbal terms change" you are then obligated to give it back to them. To tricky which is why I always say, first qualified tenant that gets F/L/SD gets it - I do not hold ANYTHING.
