State Specific Question About: NORTH CAROLINA (NC)

I own a condo in NC. My tenant has not paid the rent for the month of August. Do I need to use an attorney to notify the tenant of possible eviction? Is there a form provided by the NC real estate commission which I can download without using a credit card? I don't mind paying, if necessary, but I'm not comfortable providing credit card information to an unknown party on internet.

Go to WWW.DOCSTOC.COM You can print out a free NC specific eviction notice. Go to LL/Tenant law section on MrLandlord site and you can find out what to do with your eviction notice. since you seem to be a long distance LL you may want a NC atty to handle this for you. --70.250.xxx.xxx

You make a letter, print out two copies. It states the date, tenants name and the address. In the body of the letter state the date the rent was due, the amount of the rent that is due, the date that the rent was past due. Include the amount of the rental fee.

Then you include that the tenant has 10 days to correct the failure to pay or you will move to the next step and take them to court. Give them instructions on how to pay, that is money order or cashiers check only and where to make the payment.

Sign it, go to the door of the property and if the tenant is there, hand it to them. If they are not there or don't answer the door, put it in an envelope with their name on the outside and tape it to the door. Make sure you use some kind of good tape, not scotch type tape, so it won't fall off or blow away.

On the second copy of the letter hand write on the front of it how you posted the notice. For example, "Posted at the door at 1052AM on 28Aug2009." or, "Put in the tenants hand at 1052AM on 28Aug2009.", and sign the statement.

That is your evidence for the court that notice was properly posted.

not wise to use your full name here.i start eviction on the 5th if mo rent and think u should too if your state lets u.get a local atty if u havent evicted before . if its over 30 mile drive to the rental i think its too far and u should sell.a few guys here do long distance successfully but its asking for trouble for average LL in my opinion. --208.58.x.xx
