If they have not paid rent you evict for non payment of rent. It is the quickest and safest way to get them out of your property.

Being unsure about your relationship w/the local PD or what their policies are, it's tough to give too much advice. In FDL, we have a nuisance ordinance, which includes drugs and noise complaints. Your community may have something similar.
If you don't have an active relationship w/your PD, I would consult your local apartment assoc. to find out what might be appropriate in your area.
As for state law, you absolutely can evict for drug use, (always a good idea to have an obeying the law and drug free clauses in your lease)but it will be up to you to prove it should it go to court. A non-payment eviction would work if, in fact, they are not current w/rent. Non-payment is easy enouth to prove.

Ask a policeman to help you test the smoke detector next time you do a monthly inspection, you need lots of police reports to have tenant ejected, under the obvious situation they do not pay rent when in jail and become evicted this way - non payment of rent is the universal method of eviction, to verify the noise complaints you need police reports and if you can get a policeman to testify how many people were removed on a given party it will help but schedule conflict often prevents them from appearing. --76.241.xxx.xxx |
