If you already have the court date, and he has been served of the date, yes I would. Then you will have a judgement against him for the amount he owes to record and try to collect.

You need an experienced AL LL to answer this.
In many states, you cannot proceed with the eviction if possession is no longer in issue. It all depends on Alabama civil procedure.

Research your local laws, in most areas there is a property recovery and then a few weeks later is the money or damages award - I would call the court and ask them how to transfer your case from stage 1 into stage 2, you will prolly still have to get the writ so you can change the locks unless they handed the keys over already. --99.147.xx.xx |

u say he is gone.do u have keys or are u just guessing hes gone?many leave and leave a little junk so we have to guess.did they really move?i would go after him for the money if he left keys but carefully follow local laws which differ.if no keys left he could say he still lives there. --208.58.x.xx |
