State Specific Question About: KANSAS (KS)

Does anyone know what my remedies are for Garnishee( employer) who doesn't respond to The Request for Earnings Garnishment? It seems that I was told once that should they fail to respnd in the time allowed ( 30days) that I could hold them responsible for the amount that The Judgement Debtor ( employee) owed. Is that correct ? --70.250.xxx.xxx

I have two suggestions I learned from the school of hard knocks.

1. Call the employer and ask if they have received the paperwork from the court. My experience is that HR doesn't care about protecting the employee.

2. If the answer to #1 is no, get a copy of the paperwork from the court and send it to the employer.

I had this same problem last year. The court was not getting the paperwork to the employer from two different court visits.

The third time around I asked for a copy from the court and sent it to the employer myself. The employer filled it out sent it to the court and sent me a copy.

On my next court visit the court didn't have the paperwork. I showed my copy to the judge and got my garnishment.

The deadbeat was fired, but I did receive four payments. --99.10.xxx.xxx

I know that the Employer got it cause the Court Clerk sent me a copy showing the sheriff served them with the papers and Who signed for it with date and time , --70.250.xxx.xxx

Maybe the next step is to contact HR with that information and make sure it reached them. I work in a large company and we lose stuff all the time. --199.20.x.x

It's the local Nursing home and their don't have a reputation for doing much of anything right So I guess maybe next week I might just go over there and see what's up. --70.250.xxx.xxx
