State Specific Question About: WASHINGTON (WA)

I have a new tenant that has been unable to pay first month's rent. I've probably been too lenient in trying to collect and giving her extra time but it is now time to take action. She has signed a 12mo lease agreement. First month rent was paid but the check bounced after 10 days. Since then's she's been messaging that she is expecting to receive funds and asks for an extension. At this point, I feel uncomfortable having her as a tenant and am thinking about breaking the agreement. My primary question is: "Do we have a legal lease agreement if the initial payment turned out to be a bounced check?" Do I have grounds for eviction?"

When doing reference checks, her past history indicated that it was 'safe' to rent to the tenant. Any advice would be appreciated.

Non payment of rent is easy to pursue legally, much easier than trying to build a case against her to break the lease based on writing a bad check.

I would start the legal process, which means serve her a pay/vacate notice. For even more impact, hire a service to do this for you. If you are near Seattle, check out ltservices.net , a company that specializes in eviction. This web site also has info about the process, and....FORMS.

Nonpayment of initial funds voids my Lease (no, I haven't been tested yet, but they all pay). NOnpayment of rent twice in a 12 month period is a default under my Lease and terminates it at my discretion. They sign it up front.

No problems yet.

you know right now I am paying "Stupid Tax" for not getting rid of a tenant who started out just like the one you're talking about. From the very first she was late, paid in bits and pieces , I fell for the "my child support check is late" well now I've been to court, I'm paying to have her evicted , I'm kicking myself in the butt for being such a dumb Butt. Call the bad check hotline in your county. Normally, first, last and s.d. count while normal rent checks are treated less seriously.

Still, bouncing a check for more than $ 400 might cause her problems.

Get tough, ask for the keys back and have her sign a retraction of the lease. If I was her, I would do anything to avoid the LL from pressing charges for passing a bad check.

Keep calling her bank, when she has funds, you can collect :P

I tried the county district attorney bad check program and they told me they don't go after rent checks.

I then filed a private criminal complaint at the dj, the DA then went after the bad check writers, sent a warrant out for their arrest and I got paid. --96.249.xxx.xxx

what did her last 2 landlords say of her?be suure its the actual LL.u can call property tax people to get his address then get tel no from phone people.about 10% of landlords arent landlords at all from what i hear.try to talk to last 2 bcs last guy may be trying to get rid of them.i dont think a proper credit ck was conducted on this bum.best wishes gretchen --208.58.x.xx
