It's a hit or miss, i.e varies greatly from state to state...so wait for an OR responder to give you the real deal response...

Genearic/normal rule of thumb is that as long as you do not charge exhorbant fees, it may be acceptable by the court judge if it gets to that stage...

What is normal fee? Check/call some cleaning service co's. to inquire what their hourly fee is...probably $15-20/ho or so...plus landfill fees... --70.109.xx.xxx

You may charge the prevailing wage, in my state.

If not in your state them write your mother or brother a check, and do the work.

I like that idea about the family member!! That will be my fallback position if Oregon Statute doesn't allow me to charge for my labor.

It's not spelled out in our statute. Only addresses what the security deposit is to be used for.

have as part of your lease a minimum charges and fees schedule. with what the charges will be if bulbs are missing dryer vent missing toilet seat broken doors with holes, kitchen not cleaned, baths not cleaned and place a dollar amount next to each item -- etc. it should have a repair section and a replacement. Like carpet that's missing-- 1800 -- repair side would be carpet not cleaned -- bedroom carpet cleaning @ 45 each bdrm -- great room @ 65.

it's signed at move in-- we have many a judge question 5 dollar light bulbs but when we show they agreed to it on move in it's a shut and closed case. We tell the judge if they didn't like it why did they agree to it-- they should have disagreed before signing.

second create a sole proprity -- a company for lets say home improvement called OR HOME IMPROVEMENT.

now you have a company that will bill you and you can keep track of damages a little better. when you go to court you will have a bill from OR HOME IMPROVEMENT to submit. think of how small a cost this would be:

business lic., checking account, credit card in Co name, and post office box rental. --74.184.xxx.xx

several of you miss the point. when you go to court to certify your judgement---- it's a piece of cake when the bill is in a company --- never had one judge ask if the company was owned by us.

have heard several dozen times in court when landloed submitted bill-- told the judge he did the work--- judge then said well it must be normal wear and tear.

A written staement is not submisable in court for collections -- you need a bill and sometimes canceled check showing payment= if you use your other comapny to do the work-- write that company a check and deposit it -- simple.

Thanks very much for the replies and great ideas. I do have a cleaning addendum for that sets a dollar amount to be charged if the tenant doesn't complete all of the items on the cleaning list. I charge for light bulbs too! I think I have it at $2.50 per bulb. What it doesn't specify is my time spent hauling junk to curb for pick up, picking up dog's poop in backyard, etc...

I'm going to add a clause to my cleaning addendum stating what the charge for my time will be for any other tenant-caused repairs, cleaning above normal wear and tear, junk removal, etc...

I am a landlord and a licensed professional. In California I am allowed to charge my tenant for repairs caused by the tenants. However, in our kanagroo courts, the Judges often say that I'm not out of pocket -- they aren't going to rule in my favor for the "LABOR", will only award the "COST/MATERIALS" only. If I employ other contractors to effect the repairs, I will win the costs -- but won't be able to collect from most dead beet tenants. It's a no win situation.
