State Specific Question About: WISCONSIN (WI)

With a 29 day notice, the city of Madison has reduced the voucher amounts of most tenants by an average of $200 a month. Never mind that there is a lease, the City is telling tenants to "work with their landlords to reduce the rent or be mutually let out of their leases".

How can the city just up and do this? I feel for the tenants, but also for the landlords. I have 18 section 8 tenants, at an average shortage of $200 per month - not only will have to evict tenants, I won't be able to pay mortgages!

Is this legal mid-lease?

I can't respond as to whether or not this is legal, but it's typical of so many situations we're encountering. Our town decided to revoke the raises that were given to village employees two months after they were issued. My guess is that the city of Madison will tell you that they had to do this as a budget cut and you can either accept it or find new tenants. Let us know how this develops. I am on hold as far as buying any more properties right now because of concerns such as this and others we've been hearing about with rising taxes, fees, etc. I can afford what I have, but I'm cautious about over extending, even though prices on houses are down. --76.224.xxx.xxx

That was done in my area several years ago - but mainly for the higher priced rentals, so I wasn't affected. And by then I only had a couple of Section 8 tenants.

Here it was done with less notice than what you got. I think it was about 2 weeks. It was a cut in the total rent, which I think came all from the Housing Authority share.

The Housing Authority explained that somewhere in fine print they had the right to do it. However, if an owner seeks a rent increase, I think the present requirement is 60 days, with signatures of agreement of both the owner and the tenant.

Luckily, I'm in a small area - meaning there a few landlords on the Sec8 program to begin with.

If they pulled that here, I think most of us would tell them to stuff it, and there would be no places for them to rent.

That's it exactly. In 2007 they made it a law that you can't deny section 8 on that basis alone. They gave them more money so that they could integrate into neighborhoods and not all be "quarentined" off into one neighborhood or area. Now they have cut the funding leaving them, and me as the landlord, out hanging. That is exactly what will happen - good or bad- they will all be sectioned off again. --24.196.xxx.xx

I read in the paper that it was only an average of $100/month. Are your tenants amounts reduced 200/month? I currently have 3 in the Section 8 program in Madison. I'll have to check with my PM to find out what happened with mine. --66.82.x.xx

Apparently it must be legal. I agree, it is not right to do that to tenants in the middle of a lease or worse yet, in the beginning of a lease, too. So time to raise standards so that they can't get in?? Or time to require a co-signer. Boy, what do you think of LL registration that they are now proposing again?

I just talked to my PM. He said one of his tenants (not mine) had their subsidy reduced from full rent of 850 down to 350 in Madison. That's crazy!!

My 3 got reduced by about $100, (from full) $200, and I don't know about the 3rd since she's out at the end of the month anyway.

So, Kathy, out of the approximately $550,000 of the reduction you get a total reduction of 42K in one year??? We get 14 LLs like you and the rest of us wouldn't need any rent reduction. That's crazy. --66.82.x.xx

There's no law forcing the government to subsidize housing to the masses. I agree, they should freeze new entries and keep current leases as is. They are lowering what the "standard" is for 4 and 3 bedrooms. On paper, they are lowering the voucher amount or the amount the pay for the rent, thereby raising the portion that the tenant must pay.

An example: tenant has been paying 126 on the 1200 rent. They now must pay 250. If they can't they have to move (break lease) or get behind and be evicted.

What this means to me is I have 22 tenants who will possibly short me an average of 200 bucks beginning 29 days after notice. This could also mean court fees if I have to evict.

Not to mention that since they have brought Section 8 into the burbs, I now have many all in one area (friends, relatives, etc...) with lowering the standard, if these tenants move, new Section 8 will not qualify, and non section 8's will probably not want to live in this area now.

I read the article in the paper again. This is a 5 month situation. They have to make up the difference for all of 2009 in 5 months. Although... we don't know what 2010 will bring either. When I looked at the HUD sight for Madison for "final 2009" amounts, it did not look any different than before (but my units are all 2 BR). 2 BR was still at 846/month. --69.19.xx.xx
