State Specific Question About: WASHINGTON (WA)

A Federal Search warrant was executed at my rental property. The search warrant was looking for drugs. Can I assume the probable cause that issued the search warrant is enough to breach the 'waste Nuisance clause' of the RCW 59? --207.15.xx.xxx

Interesting question.

Probable cause to believe that a crime has been committed and that there is evidence of that crime on the premises is not, in my opinion, necessarily a sufficient basis for a Notice To Cure Or Quit.

I think you need to try to get the federal cops to tell you what this is about and if they will work with you to remove these tenants.

As to your local "waste nuisance" law, I am not knowledgeable.

The fact that the authorities searched the premises is not proof that anything wrong was occuring. They are innocent until proven guilty. If they found drugs you probably have grounds for eviction. But the fact that the authorities thought there was some and there wasn't (or at least they didn't find them) isn't grounds for any action against the tenants.

I know a business that was raided for drugs and a drugs lab, also they grabbed the company books to prove tax evasion. In then end there were no drugs, no lab, and no tax evasion. But their reputation was shot. --207.200.xxx.xx
