State Specific Question About: MARYLAND (MD)

For security deposit return my lease states....A written accounting of said charges shall be presented to resident within 5 days of move out. I have a tenant insisting on receipts of what I did to keep her $275 security deposit which was paid to me by a charity when she moved in....and she still owed me $30 from back rent in 07! Does anyone know if I am obligated to giver her receipts! --71.58.xxx.xxx

Why on earth would you have a written agreement to provide SD in FIVE days after moveout????? Change your lease to say provide within the timeframe required by state law.

Sounds to me you don't have the receipts because maybe you didn't do the work yet? In CA we are now required to supply all receipts if deductions are over $125 but I have ALWAYS provided them..even if deductions were $10. I treat my tenants as I would like others to treat me.

Why is she getting the SD and not the charity that paid it?Is it written that the charity gave it?So once again if she didn't give it,why should it go to her? If the charity wants to give it to her then let THEM.And change it to state law-5 days is not enough time to assess damamges. --76.98.xxx.xxx

First of all, Unless the rental agreement states that the SD belongs to or was paid by anybody else, then it says it was paid by and belongs to the tenant. It doesn't matter if it was the President of The United States of America who wrote the check, the RA shows that it was recieved from the tenant.

Aside from that, if the lease states that all you need is a written accounting, then that's all you need. You could still easily settle any potential disputes by offering receipts, unless you're hiding something. Don't assume that because the SD was paid by a charity that you are entitled to keep it. Only deduct actual expenses, including back rent. --98.232.xxx.xxx

MD statutes gives the LL 45 days to return the SD accounting...
