State Specific Question About: WASHINGTON (WA)

My new tenant (quite charming) wrote me a check as part of the move-in cost, and I gave her the keys. She had already moved in when ten days later my bank finally informs me that the check is no good. After checking with the tenant's bank, all they would tell me is it was insufficient funds. Now I am getting put off and storied by this lady, and she does not come by with the money as promised or return my calls now. She has been there almost 20 days, and lied about how many pets, her income, and I did a background check that showed nothing out of place. What can I do to put a stop to this as soon as possible? --67.183.xxx.x

Reinstall your backbone and DEMONSTRATE that you are the boss. The end result though will be (MUST be) an eviction and later starting everything all over again to get a new tenant. Once you are resigned to this reality... the rest is just procedural.

Bad checks are a CRIMINAL offense.

Not paying rent is a CIVIL offense.

I'd file against her first thing Monday morning on both.

Bite the bullet and hire an eviction attorney at 8:00 a.m. tomorrow. Send the appropriate notices as required by your laws. If she calls, then tell her you will no longer communicate with her as litigation is pending. Do not under any circumstances allow her to stay. It will only continue and you will be out more money in rent in the near future. Be sure to read up on the laws of your state. Its actually a good thing she bounced a check, now you can file hot check charges on her and cross your fingers it will check up with her through a warrant.

In the future, certified funds for deposit and move-in only. How did you find out she was lying about her income? Be sure to get copies of two recent paycheck stubs in the future. --99.163.xxx.xx

First you need to send her a letter and give her 10 days to pay the check, after that you may go to court or go to the prosecutor, now laws do differ state to state.

A good business person deposits a check the same day, and sometimes at their bank...

I did deposit the check on the same day received, but the process of getting it cleared took 10 days until the bank sent me a notice of the NSF status. Meantime, she gave me part of the deposit in cash, and I gave her the keys. I did show her the bounced check and she gave me a story and it's been lie, lie since then. Do I really have to give her 10 days to pay that check? Her next months' rent is only 12 days away from being due now... --67.183.xxx.x

Never give possession until ALL move in money is paid via certified funds..no exceptions.

Always include full income verification in screening process.

And of course at least TWO prior landlord references.

This tenant "saw you coming" in that you didn't follow standard rules of requiring certified funds and seemingly "bought" the income w/o verifying it directly.

You will need to evict at this point. Call a local fixed fee eviction firm and get on this today. Follow state laws and please change your procedures based on above to avoid getting yourself in this situation again! --207.200.xxx.xxx

She gave you part in cash and part in check...... SHE NEVER HAD THE MONEY AND KNEW IT. Do NOT listen to any excuses. She is a liar since "day 1" and will be a liar until the day she is evicted. She knew what she was doing and unfortunatley you didn't.

If you have any doubt on the process for legal eviction, hire a lawyer now! Stop all communication with the parasite as she will just get you more upset with nore lies.

Choose an eviction speciaslist who offers a flat rate service. He will do the serving of notices as well.

Call the bad check restitution hotline at your D.A.'s office.

You have a pro tenant on your hands, stop wasting time, EVICT!

Furthermore, keep calling to ask when funds are sufficient, then race to cash the check - again :P

Go to the Police, press criminal charges. How much was the check for? In CA, it matters when it's a first month or sec.dep. check... Good luck and take control. she will just keep stringing you along... --125.25.xx.xxx

I'm sorry things went this way. You're experiencing a painful but potentially valuable lesson. As Terry said, never let the tenant into the property until you have deposit and first month's rent in CERTIFIED funds. And if you get the runaround, file for eviction immnediately. Next time you evaluate potential tenants, be sure to run a credit check, verify income and employment(tax return or recent pay stub), and check with prior landlords. I wouldn't be surprised to find out that this person has an eviction in her background, and she almost certainly has bad credit. --70.143.xx.xxx

Where are you located? If near Seattle, check out the web site ltservices.net for a flat rate eviction service.

I would meet with her tomorrow and give her an option to start paying with cash, money order or cashier's check if she wants to avoid eviction. Do not take any more checks from her. If she doesn't want to get evicted, she needs to get you money tomorrow and regularly after that until she's caught up.

if i took a ck i would call the bank and verify its good.u read them the acct number at the bottom of the ck.never give keys until u are sure u have the money-either cash or money order or ck u verified at her bank by phone with her acct number.did u ask previous LL how were her pets?often prospects lie about pets.if he doesnt make the ck good with cash within several days of notice i would file police charges.writing bad cks is usually a criminal charge.its time u started eviction.if u havent done it before i wwould contact a landlord tenant atty.maybe someone can give u a name otr maybe u have a friend in the biz who can give u a name or see yellow pages where they are listed by specialty here. --208.58.x.xx
