State Specific Question About: GEORGIA (GA)

tenant had no written lease; is behind on rent and utilities two months; moved most possessions, left a few odds and ends behind. I was in the house a month ago and left my set of keys in the door, they disappeared, now i don't have keys to the property. The only reason I know they moved is because neighbors called me to tell me they saw a u-haul hauling stuff off. I looking in the windows to assess the situation. How long before I can enter and change the locks and re-rent the property? --67.191.xxx.xxx

Enter IMMEDIATELY. break a window or hire a locksmith (whichever costs less).

Secure. Clean. Advertise. Re-Rent. Move on.

But mostly? read and LEARN what the LL/Tenant laws are. Above is a good starter link to state laws. Use it.

If you wish to get the unit "legally" back in your name, you file for a "dispossessory affidavit" in Georgia.

Google the Civil/Magistrate court in your county for instructions on how to do this.

Why don't you have set of keys for your house? Landlord should ALWAYS have set of keys. I'd suggest you call a locksmith, have locks changed, get set of keys. Then call your tenant and tell him he/she can get new set (assuming they still live there.)

Even if you do a "dispossessory affidavit" in Georgia....sooner or later, you are gonna have to figure out just how you are gonna get in the rental since you no longer have keys...

One has to evaluate the "risk vs. rewards" of breaking in to attempt to regain possession of the rental...Long time experienced LLs will know when the potential risks seem low...

By asking this question...I would suspect you are not that experienced..so perhaps best for you to take the slow and safe legal approach...
