State Specific Question About: COLORADO (CO) Are day cares considered a business when renting to a tenant? I have heard a tenant can not be denied to start a day care center in a rented property even if the lease says no business can be run out of the property.

I am not aware of any statute or ordinance that requires a landlord to allow a daycare. Yes, it is a business as services are provided for a fee. I do not allow them as it increases risk exposure and traffic. If your home is in a HOA, be especially careful as the covenants will likely disallow any business that creates additional traffic. --209.181.xx.xx

NONONONONO! If you ALLOW any kind of daycare facility to operate on your property, and anyone's child gets hurt--or God forbid!--dies, who do you think the grieving parents are going to sue? The renter who has no money and owns nothing worth taking?? NO--it will be YOU--the big rich greedy LL who will have mucho insurance!

In court the judge will hear from the parents how you "knowingly allowed" such a dangerous place! (Of course it is never the fault of the poor parents who KNOWLINGLY PLACED their own child in there.) But I highly suspect your insurance company will canx your liability insurance if they find out you have allowed such a risk.

To my knowledge it is only CA that forces LLs to allow daycare. --140.140.xx.x

I had one in CLE about 2 years ago, they must have a city license which requires heavy insurance, they get inspected every 2 weeks, plus surprise inspections if someone complains about their kid getting in a fight with another and any physical harm occurs, the lady got her full time job back and her daughter went to college - after they saved up the day care money prolly... --76.241.xxx.xxx
