Who is responsible for damages when someone breaks into the rental house and does damage to the property? The tenant or the landlord? What if this happens repeatedly? --69.154.xxx.xxx

You rent a car and it gets damaged, who pays? The optional insurance the renter was offered at the beginning of the rental, (renters insurance) pays, or renter declines and agrees to be held liable for damages. Same principle applies... --67.191.x.xx

I had a tenant that invited guess to stay for about a week. One of their children threw a ball and broke the front window from inside the house. My tenant tried to say it was broke from the outside, like a stranger did it. I said it doesn't matter-inside-outside, You Are Responsible because you have the possession.

I told her to make the guess pay, but they wouldn't pay. So tenant was charged for the damage. --76.234.xxx.xx

We had a breakin and a month later filed an eviction to get rid of the tenants. In the eviction we asked for recovery of money we spent to repair the breakin damage. The magistrate refused our request. --96.236.xx.x

Obviously this isn't a cut and dry issue. I had a wonderful tenant who was broken into by some young men 2 times and they took over $50k in property. My husband caught them the first time and I saw them leaving the second time. They left prints that time and one was finally caught. The tenant was more concerned for our safety than his things. There is no way we were going to charge him to fix our property. We fixed it and claimed the expenses on our taxes.

Another tenant was broken into by one of her son's friends. He had left the window open. We didn't fix anything that time.

So, what are the circumstances? I wouldn't just assume that it was them or someone they know. How much $ are you talking about. What about splitting the cost if it is that much? Will you loose a good tenant by forcing them to pay for damage to your property that they didn't cause? Some things to think about then make the decision you are comfortable with.
