State Specific Question About: MARYLAND (MD)

If a tenant has not cleared out all there belongings by the end of the month but you let them come back to do so to avoid having to do it yourself can you take $ off security deposit if they end up leaving unit in ok shape? Not sure yet as they have still not got everything out and unit was a mess on the 1st! Thank-you --71.58.xxx.xx

I have learned that they rarely come back and you end up waiting for them. I decided years ago that if your lease is up and your stuff isn't out and it isn't clean too bad. The locks are changed.You can put the stuff in storage and charge them. I would bet that they do not come back and I would not waste my time waiting. --76.98.xxx.xxx

If you really want them to remove the things from the home,and are feeling generous,I would change the locks and call them ONE time and let them know to call you to set up an appointment in the week to arrange to pick up the belongings. --76.98.xxx.xxx

Did you do move-out inspection and get the keys? If so, that was the day they moved out and (assuming they gave proper notice), the last day you can charge rent. If you let them back in after that, they are not in possession, you are.

If they still have the keys in hand, they are still in possession and the rent clock is still running.

Based on the way your post was worded, it sounds like they gave you notice for the end of May. Giving notice and moving out are two separate things - what matters is whether they are still legally in possession. --74.176.xxx.xxx
