State Specific Question About: IOWA (IA)

Tenant's are 2 month's in rears. On a month to month. Given a 30 day May 9th, but it has become apparent to me they are not planning to leave (electic service just reconnected under different family members - not on lease- name. I'm assuming, I will need to file an illegal detainer suit and go through eviction process. Is this correct? Any knowledable help would be apprectiated. Thank you. --207.118.xxx.xxx

You will have to file for eviction. If you are not familiar with the process get an attorney who lists landlord tenant law in the yellow pages ad.

Do not give the lawyer a retainer. They will use it up and ask for more after sending a few letters. Find one that charges a flat fee for an eviction.

You can file papers at the courthouse to start the process and then just show up on the court date with your rent book and evidence that these folks did not pay.

If you gave them receipts and they don't have one for those two months then you win or they may not show up at all and then you win by default. --76.99.xxx.xx

Study your local and state laws, post a 3 or 5 day notice with a photo of the front page of the newspaper taped next to it for proof of service, then wait and file eviction in court, hopefully you have already spent a few learning sessions in the courtroom to understand the process and what the judge expects from each party to prove his/her case, if not get in there and watch how liars court goes along for both sides, hire a flat fee eviction atty as Ally mentioned, you will have observed this person in action while you were getting your on-the-job training. --76.241.xxx.xxx

They are not leaving because they have no place to go as no one will accept them. Since the electric was shut off in their name prior to having it restores in a family member's name it is 100% clear they don't have money. Your ONLY choice is to evict, but expect them to go the whole 9 yards during the eviction.

I thought to have the power turned on you had to have a signed copy of the lease, which would include the owner/LL's name... Call the power company and inquire if such was submitted and if your signature has been FORGED! Tell the Electric company that the same lowlifes are in the house and that they've been had! The electric companies have their own security/fraud section and have no problem filing criminal charges and removing meters! --67.191.x.xx

You can use the power in someone else's name 2 ways-

Proves someone on the lease is not living there

Proves current occupants can't pay rent or pay utilitues- both are grounds for eviction here

You should have filed for eviction 2 months ago.

This is a business not charity. Sorry for the tough love. I start evictions on the 5th of the ist month that rent is late --24.21.xxx.xx

Bert, the first thing I would do is to call your local courthouse (local for your rental property). Ask when and where they have Unlawful Detainer (also known as Eviction) hearings.

Then, go visit the court to watch the Unlawful Detainer hearings. Do this ASAP.

Study the court procedure. Watch the attorneys (they will be the ones wearing suits). Look for the attorneys who know the clerk and the bailiff, and who have multiple hearings on calendar. Look for the ones who are comfortable in court and who know exactly what they are doing.

Ask for business cards from one or more of the attorneys; introduce yourself as a local landlord. Ask the ones who look best to you if they do flat rate evictions, and if not, what their fee arrangement is.

Once you find a good attorney, get this eviction going ASAP.
