State Specific Question About: NEW MEXICO (NM)

I'm not exactly a landlord, but I am asking this question for my mother-in-law who is & not really familiar with how to handle evictions.

Here is the situation. She has a renter that paid partial rent for the month. She is now gone. Apprantley she has had a nervous break down & is now at a treatment hospital. This has happened before. It is not known how long she is going to be gone. As a result, the rest of the rent hasn't been paid & she's now behind for another month.

Can she evict & if so, how do you handle a situation like this? --63.229.xxx.xx

Before proceeding, someone in this deal should have some minimum acquaintance with NM tenant-LL laws. This should be easy to do, but your MIL may need the services of an attorney and there is probably one who will file an eviction for a flat fee and keep her out of trouble and achieve the desired result.

Clearly, your MIL needs to follow the law and not attempt to avoid doing this through the legal process. I see lots of land mines here for someone who might try to "fix" this without an eviction.

"She is now behind for another month" makes me think that your MIL could use some general help in running this rental. --98.66.xxx.xxx
