State Specific Question About: MARYLAND (MD)

My husband has a tenant in Baltimore CO., Her & her elderly mother are on the lease. She got married & decided to move her mother out and him (unemployed) in. Now they are both unemployed and he just got out of rehab! The mother is still on the lease and of course gets social security. They are behind in May's rent and June is due in a few days! Can the mother's social security check be attached for back rent if we go to court or is that untouchable? Can we evict due to her husband not being on the lease? I need help I am only familiar with Carroll Co. courts not Baltimore I hear its a whole different ballgame! Thank-you! --71.58.xxx.xx

SS income is exempt unless she mixes it with non-exempt income in a common account. No judge will evict a spouse. That would be against public policy. You have to get rid of both of them, which sounds like that must happen anyway since there is a non-payment issue. --192.234.xxx.xxx
