State Specific Question About: CONNECTICUT (CT)

If a tenant moves out without giving 30 days notice as stated in the lease, am I required to give back the security deposit? --69.120.xxx.xxx

In most states you must still provide the resident with an accounting of their security deposit. If your state allows you to keep it to offset for unpaid rent then you account for it that way and send them the accounting. In NH if a tenant neglects to tell us their new address I do not have to return the security deposit, I do have to hold it for them for 6 months, at which time it becomes ours.

The law for us reads in returning security deposits under RSA540: "a landlord shall not be liable nor forfeit any rights if his failure to comply with said sections and paragraph is due to the failure of the tenant to notify the landlord of his new address upon termination of the tenancy. Any deposits plus interest due on the deposit that remain unclaimed after 6 months from the termination of the tenancy shall become the property of the landlord, free and clear of any claim of the tenant, absent fraud.".

I'm currently counting down six months for a security deposit. --75.144.xxx.xxx

As Lisa noted, the rules will vary by location. In Missouri it the tenant does not give 30 days notice I am entitled to deduct a pro-rated amount to offset the lack of notice. So if tenant gives on 15 days notice, I can deduct 1/2 month's rent from the deposit for example. --204.80.xxx.xx

Tenant has left forwarding address and is demanding return of his security deposit. But, not only did he not give 30 day notice, he moved out in 2 days, but has left much damage. Ruined rugs, scraped walls, roach infestation,etc. and was a tenant for only 7 months. --69.120.xxx.xxx

He signed a binding contract. Not only does he owe you rent for MAY--he actually owes you for as many months rent as it takes for you to re-rent the unit!

So, in your accounting you start with the deposit amount $0000 and subtract for repairs of all damages:(example)

Carpet cleaning-----$180

Repair wall damage---175

Repaint repaired area-90

Exterminater---------200

Bathroom cleaniing----xxx

Range/oven cleaning----xx

Change locks-----------xx, etc

Unpaid rent May 09--- XXX

Unpaid late fee--------xx

In the end he will owe you MORE than his SD, and enclosed in the envelope with his acctg should be your reqest for him to pay the amount still owing to you!

It is my understanding that there is no notice requirement on the tenant's behalf in CT. You can write it into your lease that the tenant has to give notice, but rarely does a contract override the law.

The good thing is that in the end you won't have to keep his security deposit because of lack of notice. You'll keep his deposit for the damages he left. Roach infestation - GROSS! --74.179.xxx.xx

Linda gave several good expamples of deductions...I would alsos add advertising expenses to get the unit re-rented...and give a deadline for payment for the extra money owed...after the deadline, I would file in small claims court for the extra owed... --70.109.xx.xxx
