An inherited tenant that signed a 1 year lease ending May 31 said today, May 6 she is leaving at end of lease. When can she leave, May 31, June 6 or June 31? --67.224.x.xxx

What does the lease say about it?

Lease just says one year. Very old lease form used by former owner. I thought it would automatically change to month to month. So I wouldn't have to give 30 day notice either? --67.224.x.xxx

She can leave any time she wants.

When she can stop paying rent is another story, depending upon your Lease and state law.

Most states allow leases to revert to MTM.

However, I wouldn't enjoy it, but I wouldn't make a big hassle out of it. She's still going to leave. Focus on getting her to leave with the place immaculate, so you can re-rent quickly. --65.54.xxx.xx

It does not matter what day or date is on any lease the tenant can leave anytime they wish.

It then becomes incumbent on you as to what you are going to do about it.

I wouldn't be arguing with someone over a couple of weeks rent. Like Nancy said, concentrate on getting them to leave the place clean and to take all their junk with them. The more they do the less it costs you. --24.136.xxx.xx

I try to make all move outs a win-win thing...

Whenever I get a notice of intent of tenant moving...I send a move out letter...which starts off by saying..."In order to achieve the maximum return of your security deposit...you need to keep the rental tidy and showable within unobtusive showing times and days, clean the rental to the move in condition, etc..as well as to offer to pro-rate their last month rent if they moved out a few days early before the end of the month..."

But my past tenants were upper income tenants, so this might not work for you..but you might try it... --70.109.xx.xxx

It depends on what is in the lease. Some leases required a 60 day notice but not ocmmon.

I also would not worry about a few days. You would probably be able to rent it on June 1st easier than June 6th and may lose a prospective tenant if they could not get in until June 30.

At least they were close with a 30 days...like only 5 days short...if a tenant gives a week notice than I may be more apt to try to get an additional months rent, if I can and if I am not able to find a new tenant that fast.

I also agree to try to get the tenant to clean and have the unit ready for a prospective tenant to see in a showing and have no problems with all that could go wrong.

I'd let her leave, use this to leverage a good clean up upon move-out.

You can say, they "technically" needed to give 30 day notice, but if you do "XXXX" you'll over-look the extra month's rent they'd be liable for... --75.170.xx.xxx
