Why would you want to?

If they're good tenants, keep them. When they leave, advertise it as 'smokers welcome'.

Tell them it's unhealthy and a horrible habit, first. Not something you support as they should be ashamed. If you don't act, it may be construed as passive support of their bad habits. For example, if you allow prostitution in your rental, you would be in trouble. So allowing the dangerous and healthy habit of smoking be used agaist you? In the future I would think so.

Give them notice, you have healthy rentals and will change agreement if or unless they stop. People think they have freedoms, but that freedom ends when they practice unsafe, hazardous, or unhealthy habits. Then it's our job to take those choices away. Most just don't get it and without force will make unhealthy choices. Together we can knock off bad choice and make a better country. Sometimes by law, regulation, taxes, or just shame, but if we hold together we can force most to comply with the majority of wisdom. The power of Democratic rule.

Remember just about any activity will effect the environment, so that is a big birth to control bad behavior. Smokers pollute our air. There was a time, of countries History, where upon the Supreme Court had less power untill ruling on Interstate Commerce Clause. That ruling open the door to all inclusive jurisdiction upon country. Same with modern development of Environmental law, it slammed the door open to all human activity control, especially with earth harming Global Warming emergency. --4.154.xxx.xx

the time to screen them is before they move in.i only allow smokers in top floor of 3 fam.fewer complaints bcs smoke rises.if they have been there for years i would just go ahead like it is but only allow smokers on top floor in future.in 3 fam it makes a big difference in number of complaints bcs smoke rises.i have a couople in a top apt for years and i didnt even know they smoked until very recently.no complaints.i had a family in second floor in other bldg and son smoked.complaints about yearly from others. --208.58.x.xx
