State Specific Question About: RHODE ISLAND (RI)

I would like to give my tenant notice to vacate the apartment. How much notice do I have to give and where can I find an appropriate letter (for free) to give her notice? --72.209.xx.xx

What does your rental agreement say about it?

Why do you want them to go? If it's for nonpayment of rent just give notice to quit per your state regulations.

If your rental agreement does not address this & it's not for nonpayment then give them 1 rental period's notice. For instance if the rent is due on the 1st of each month then before May 1, 2009 sent them a letter stating that your are terminating their tenancy effective May 31, 2009. Make sure that you keep a copy of the letter.

You do not have to give them a reason. If they press you for one just state that you have other plans for the unit.

PS if this is a S8 unit the length of notice may be different.

explain in detail pls why u want them out.if they just have a few little problems but pay on time it might cost u 4 or 5 k to get them out and next guys wont be perfect either. --208.58.x.xx

Assuming that you just want them out, they have not defaulted on the lease, and the initial term of the lease is up, so that they are a "tenant at will" - month to month. The just give them written notice with the length of time per your lease or per the law of RI. You DO NOT owe them an explanation and my experience is that is best not to give them one.

If you give them a reason, that opens to door to an argument.

When I have to do this, tenant asks why, my answer is "When tenants give me notice, they are not required to state a reason. It works both ways. You have your notice and I will be giving you the move out and cleaning requirements within the week."

Believe me, if there is a reason, the tenant knows what that reason is. --74.190.xx.xxx
