State Specific Question About: DELAWARE (DE)

hello i live in md and i am about to purchase a house in delaware that i want to rent out. this is the first time being a landlord and was wondering do i need to hire a lawyer to create a lease or does the state have generic type forms and any advice that may save me some money where im just starting out would be greatly appreciated. also do you know of any good lawyers who deal with landlording start ups in case i might need one. thank you paul --70.22.xxx.xxx

There is a group of landlords around the university, they are organized and have a lease. Search for their organization and you will find that their lease will cover everything...down to the world ending during a lease period.

I still get my leases at the stationery store. It is published by the Blumberg Company and they have a catalog.

If you go to one like Staples you will also find leases. I like the Blumberg because it is very comprehensive and in plain English.

Lawyer devised leases are very open and do not list a lot of conditions that you need to mention.

I asked why once of an attorney and he said that if you list too many "don'ts" but not the one your tenant is doing, then the judge could say since that behavior is not listed it must be OK.

I think though, that lawyers like to leave them very open and leave out things like garbage handling, because they like to generate business for themselves.

It would take longer to prove a tenant was misbehaving with garbage if nothing was spelled out in the lease.

Its www.Blumberg dot com. The first column on the page says Online and Paper forms. The leases are in that column.

Read down and click on that choice. You can use a credit card to get the paper form.

Look up the names for several leasing agencies (apartment finders, housing finders, etc) in your area. Go talk to their leasing agents to get a feel for what your market is like. Ask if you can have a copy of their lease or if they have a copy online. Compare what you find so you can see what will work for you. My lease is a combination of about 8 or 9 other leases that I've added to over the years. There is no "perfect" lease. There are a lot of bad leases. The worst lease is the one you don't enforce.

Since you're starting up, I'll also mention that you should do the following BEFORE finding your first tenant:

Search this site for the following topics using the handy "search" function above:

1) eviction

2) phone screening / pre-screening

3) credit checks

4) garnishing wages

5) flooring

6) plumbing

7) electrical

8) roof

9) toilet

10) late fees / late rent
