State Specific Question About: KANSAS (KS)

Tenant abandoned mobile home on rented lot. Mobile home company says they have repossessed mobile home but refuse to move it. They say when they can get it sold the buyer will move. So nobody will move it or pay rent on lot. What are landlord's options to get mobile home off of property and what liability does landlord have if anyone enters mobile home and gets injured? --24.32.xxx.xxx

Don't know the laws in your state but I'd post a notice on the MH companies door giving them what ever notice your state requires for evicting MH's. Here I think it is 30 days as opposed to 10 days for a tenant in an apartment.

When the time expires, if the MH is still sitting on your lot, I'd go to court and have a judge tell them to get it gone. --24.136.xxx.xx

Around here, the finance company or the buyer is responsible for the lot rent. I would let them know what they owe to date and that the thing will not be moved from YOUR property until the back lot rent is current. Doesn't matter if it's the finance company or the buyer that's getting it. I've had to do it plenty. Not only the back lot rent, but the back taxes. I just bid accordingly.

If a mover comes to get it, they are trespassing on your property in order to remove the home. Especially if there is money owed to you. You could make it very difficult for them. --71.1.xxx.xxx

Every state is different , but I'd think the finance company is now responsible for any rent after they reposseses. You may need to file a lien. What does your lot lease say about these things? --74.243.xx.xx

I actually had this exact thing happen to me a few years. Finance Company was Peach Tree. I called them up (tenant gave me their acct. #) and I told them that if they didn't come and get it that I would move it to an undisclosed location and they would not get it back until the unpaid rent and moving fees were paid. Needless to say, they were in about 2 weeks and picked it up. No, I didn't get my back rent from them but I did get it off my lot and got the space re-rented. --24.224.xx.xx
