State Specific Question About: NORTH CAROLINA (NC)

I received a security deposit from an applicant that was approved, her move in date was schedule in 3 more weeks, then 2 weeks later she called and asks for her security deposit back and I told her that she will have to wait few days for it since the book keeping department could not do it right away for her. She said: I know this business for years and I know that I have the right to get my money today and what you did was illegal, I promise that you will put for this, I want my money now and you are on a lot of treble because you were not supposed to take my security deposit to the bank till I sing my lease.

After that I went to booking and ask them to please do a refund asap because I did not really want to conform this person and they did make the check. She has not come yet; however should I be calling my attorney on this one? I am new and I want to be prepared for when she comes.

Laws are based on common sense and timely response methods. What this tenant is describing would be laws based on game shows.

Any advance payment you accept prior to someone actually occupying your rental should be itentified as a "Holding Fee" that converts to security deposit upon complying with all terms of occupancy including transfer of utilities into tenants name and payment in full of all monies due in the form of a money order or certified check on a LOCAL BANK. i had a 2 tenants,the day after we signed a lease, one was incarcerated and the other wanted me to run down there that very minute(Saturday afternoon) and give her deposit and first months rent back or her momma would call the bbb, the news station and report me..they left me messages cussing on my voice mail, and basically ruined my afternoon....i said nope, will have to go through accounting first, plus all my banks were closed. and i only gave them the first months rent back(i held the house for them for two weeks). then i wrote the check in both names. the guy ended up getting out that monday. he wanted me to give him another chance because he stated that he still has his job...i told him i didn't need this type of drama and gave him his money back..definately get them to sign a holding fee agreement stating that if they decide to change THEIR MIND(not you, but THEM), then it's non-refundable. i have held a house for two weeks, that is half of the mortgage payment....because you took YOUR property off the market for THEM, you need some kind of payment...time is money.. --74.240.x.xx

If she wants to be unreasonable and demanding while breaking the contract she just signed, make her do everything in writing.

Check you state LL/tenant laws. Here, we have 30 days to return deposits. I'd make it clear her that unreasonable demands will not result in expedient service. I wouldn't actually tell her she would have to wait 30 days, but I might hand her a copy of one page of the regulation with that section highlighted.

If you incur any addition costs to re-advertise and re-rent the unit, take em out of her deposit. That's just what it is for. Play hardball if that's what she wants. --141.129.x.xx

Thank you very much for all your help. I lear my lesson: Holding Fee and that converts to SD and I now I had a form that is call Holding Security form.

She did not show up,,, maybe tomorrow.
