State Specific Question About: MISSISSIPPI (MS) Does anyone know briefly about eviction in MS. My tenants, co-signed by parents, have been arrested, have citations by the Sheriffs dept. now and have disturbed the neighborhood for the 4th time. Their lease is up July 1. I want them out ASAP> I am going to have to try to find the MS. law regarding eviction but wondered if anyone has been through it or thought of it before. Any help and advise would be great. Thanks. My lease has QUIET enjoyment clause and also a default clause that if terms broken can result in removal by me. Doesnt have a time line though.

what part of ms are you from ? ive never been to court for this, only for non-payment. what you would need to do is send a cure or quit notice. you will also have to notify the neighbors to call police asap. you will need evidence that they are breaking the rules. i do have something in my lease about having only three complaints(i will have to go and look it up). you might call the cops and see if you can get copy of police reports if they have any. if they fail to pay ANY amount of rent, go downtown and file IMMEDIATELY.... i hope others on here can chime in...i will get back to you on this... --74.240.x.xx

Just for the heck of it almost any lease has the peaceful enjoyment clause in it, even those drug store leases you buy for 5bux, what matters is late fees and court costs to be added to the reant ans if they can buy out before court - some states have 3 late rents and you are done period - end of lease, but you still go to court for unlawful detainer. --76.241.xxx.xxx

thanks for the responses but my problem is not rent related. rent is always paid. it is the noise, neighbor complaints, partying, that is the problem. will get copies of police reports. thanks. julia --76.123.xxx.xx

If the problem is not for nonpayment, you have to give them a 30-day notice stating the violations to their lease, or a letter advising that their lease will not be renewed. Both have to be hand-delivered or attached to the door of the home. Our tenants have violated the terms of their lease AND are behind in their rent.
