State Specific Question About: ALABAMA (AL)

I would like to know when you evict and the the renters move but leave a few things in the house to keep you from entering the house how long can this go on.our renters moved but left a computer desk and the house nasty full of garbage and animal droppings.changed our locks and now are telling us if we go to that house we are trespassing!what do you do?they moved with rent due and the power in our name thats two months past due.if i cant clean and rent the house i will lose it --74.230.xx.xxx

In my leases, I have a 5 day abandonment clause. Are you sure they didn't leave the keys on the counter in the kitchen. They may of left the back door unlocked,so you could get in there. Be sure to take pics of the keys on the counter, once you get in there... --205.188.xxx.xx

no they changed the locks ,locked the house and rented another home and she is alresdy living there,but tells us we cant enter our property we are trepassing,she left her computer desk and tells us she will finish when she gets time off.we can we take back our house? --74.230.xx.xxx

Look up the abandoment law in your state. In FL if the person has been absent from the propery and is not paid in full on rent for a period of half the normal rental period (15 days for monthly payments) then it is abandoned. --24.250.xxx.xxx

You need to study your local and state laws so you can stay in control, after you file unlawful detainer with no rent and abandonment send a cert mail to old tenant for unpaid rent, no pay no stay, this is a good reason to code all your locks and put the code number on the lease paperwork, any new locks cost 25bux a pop and is billed upon discovery, do not wait for security deposit time. --76.241.xxx.xxx

In my lease I have them inital the part that says * Emergency Access. Landlord has the right of emergency access to the leased premises at any time and access during reasonable hours to inspect the property, protect the property from damage or, at reasonable times, to show property to a prospective tenant.*

Also in my lease:

Abandoned property: TENANT will notify the Owner/Landlord of any anticipated

absences from the premises of duration greater than ten (10) days. If TENANT leaves said premises unoccupied for five (5) consecutive days at any time while rent is due and unpaid, this shall be deemed and abandonment of said premises, and Owner/Landlord may, if they so desire, take immediate possession and exclude TENANT without further notice. In such event, Owner/Landlord may dispose of all of TENANTíS property remaining on said premises, and may re-rent said premises.

I have them always initial and date each of these points during their rental contract.

You have her current address? Great. You know where to serve her for damages later. Start a formal eviction. Ding her credit for the damages.

Until you have possession she still owes you rent. As long as she has control and won't even allow you on the property sounds like she has control (which is another issue) as well as legal possession.

To take back control now is difficult to say the least. If this has been going on all month, she owes you for March. Plus the damages.

There is no way she should have been allowed to chgange the locks. Most of us have a clause to either evict in that case or have a locksmith change the locks back at their expense. Since you didn't do this she knows she has the upper hand.

An OH attorney will tell you the safest route is to do an eviction. I know I asked once. It's not quite abandoned if you are in contact and she won't let you in. that is still possession.

Sounds like yo had a bad time with this one. Chase her to the gates of hell for every dime she owes you. that court judgement will look real good on her credit report. --151.213.x.xx
