State Specific Question About: NEW MEXICO (NM)

My Tenant (on month to month)gave me about a 3 day notice that he would be out Feb 28th. He was finally out March 4th. I am thinking about taking him to court (my first time) for March rent plus cleaning/repairs. Minus the damage deposit he owes me about $550.00. As I have never done this before, any thoughts or ideas? --76.113.xx.xxx

He owes you rent for March until you get it rerented, and you must attempt to rerent. Once you subtract damages and lost rent, you send him the deposit accounting. If he owes you money, you can go to small claims court. You have to decide if it's worth your time and cost to go to court. --98.227.xxx.xxx

Month to Month, and the real question was he out at the end of the month..

Bet he was, it's called Liars Court for a reason...

As for Winning, that is not a big deal Collecting is....and the only time you win is when you collect.

In my state it is $100.00 to file, and they have to be served, after you win you have to collect....and renters know the game better than LL. --68.58.xx.xx

I am with Corey.I go after them EVERY time . In the beginning it may take time to learn the rules, but it gets easier and easier. It costs 35 dollars to file. Just last week the judge said to me 'You did everything right.' Go get them and Good Luck --68.41.xxx.xx

Start by submitting a bill for unpaid rent and damages that exceed security deposit. He might surprise you by remitting.
