State Specific Question About: NEW MEXICO (NM)

I have a tenant on a month to month lease. She and her 5 yr old daughter are the only ones listed on the lease. Within one month of moving in she moved her boyfriend into the apt. About a month ago boyfriend hit tenant and she kicked him out of the apt and got a restraining order on him. She recently made up with him and moved him back in. She did pay March 1 rent.

Do I have the legal right to give her an eviction notice to be out at the end of this month? --76.113.xx.xxx

Chris, anytime a resident breaks one of the rules in your rental agreement, you as the landlord have the right to give notice to the resident to correct the violation. If the resident does not correct the violation, you can then start legal proceedings for your state to terminate the agreement. --205.188.xxx.xx

I would not bother with that part of it since you did NOT enforce it the first time he moved in. Instead do as others advised and give FULL notice (usually 30 days or full rental period which would be end of April) notice NO REASON needed/stated. u should put in your agreement "no visitors overnight without landlords prior written approval.no visitors for more thav 3 nights."i would tell her the guy has to go or they both have to go.one of these days he may kill her. --208.58.x.xx
