State Specific Question About: NEW MEXICO (NM)

I have a tenant on a month to month lease. She and her 5 yr old daughter are the only ones listed on the lease. Within one month of moving in she moved her boyfriend into the apt. I gave her one written notice about this violation. About a month ago boyfriend hit tenant and she kicked him out of the apt and got a restraining order on him. She recently made up with him and move him back in. I really want them gone!! Do I a have to wait until March 30 to give her a 30 day notice or can I get her out by the end of this month with a 7 day?? She did pay March 1 rent. --76.113.xx.xxx

Give 30 day notice today. It won't be effective until the 1st day of the next rental period, so the earlier she'll have to leave is the end of April (assuming your rent is due the 1st of each month).

"Can I get her out with a 7 day..." What do you intend to do if she doesn't leave? Physically throw her out? Turn off utilities? BEEEEGGG NO NO! You would have to evict, which is probably the course I would take anyway. If you give 30 days notice and she doesn't move out at the end of April, you'll still have to evict.

So...if you have to evict either way, I'd start today and get her out ASAP. You don't want this kind of tenant, even if baby daddy does move out again. You know the type. She's probably been abused much of her life and is now 'accepting' of it. Not that she deserves it (no victim ever does), but you can't let her problems become yours. First it's her, next it's your doors, your walls, your windows...

Get them both out ASAP. Eviction will probably be fastest. 30 days notice is...pretty much worthless. --204.80.xxx.xx

You ask for him to fill out the credit check just like she did, and he pays just like she did - offer an addendum to the lease with rent increase 50bux - they don't like this idea - 3 day cure/quit, it will hurt her credit for 5 years with eviction, in nascar they say that is gonna leave a mark. --76.241.xxx.xxx

Chris...it's a 30 day notice from the beginning of the next rental period, unless your state laws allow a flat 30-days from the date the notice is given. Either way, regardless of which way your state goes, she DOES NOT have to be out by March 31st. Even if the laws SAYS she has to be out, you have to go to court to ENFORCE the law. Oh yes, and you get to pay for it.
