State Specific Question About: OKLAHOMA (OK)

Is there a specific way that we have to post our rent? We have several people that owe back late fees that refuse to send them in can i post the next rent payment to the oldest invoices or do i have to post it to the rent for that month? --68.15.xxx.xxx

we didn't have anything in the lease about this. We have never had person that is always late on rent. I give them a 5-day notice every month but before the notice is up they come in and pay for the rent without the late fees. In Oklahoma we can't evict on late fees only so i need to know if there is any rule about posting to the late fees when on the money order it states it is for rent. --68.15.xxx.xxx

send them a letter telling them of the new and reasonable policy and that it will begin with 4/1 rent payments due. Include a tally of their unpaid balances.

They'll either pay up and shut up or grumble, not pay and move or grumble not pay and take you to court.

What is the term of the lease? Have you tried speaking with an experienced landlord tenant attorney who practices law in the same area where your rental property is located and asking for specific advice about this? He/she could advise you based on the laws that apply. It could be that landlords are required to bill the tenant in writing each time a late fee has come due in order to actually be able to collect, so you want to be sure you are protecting yourself and enforcing the terms of your lease correctly. An experienced local attorney would know how judges are ruling on late fees in the local courts. --216.244.x.xxx

You need to follow normal accounting practices and apply any payment to the oldest charge.

Do you think a mortgage company would allow you to do what they are doing?

They way they are doing it there is never a reason to ever pay the late fee.

If mine don’t pay it then they get hit again next month with the 10% late fee.

Ask them what the electric, phone or water companies would do?

You need to rewrite your lease in a legal way but a way that indicates late fees are taken before rent, so if you receive a rent without late fees you send the tenant a notice for next month fee plus rent amount using cert mail, if amount is short post pay/quit notice for non payment and get ready to follow thru with eviction, fees are fees and when they are late there will be more fees. --99.128.xx.xxx
