State Specific Question About: GEORGIA (GA)

I have a lease with a gal that rents my basement. She has been renting from me for the past 2 months. She has a boyfriend living down there (who is not on the lease) but he doesn't want to leave now, and he is an obnoxious drunk. I knew he was going to live down there for a month or two going into this, but again, now he wants to stay past the agreed upon departure time. There is nothing about him staying at the house on the lease. I have told him to leave, because it is now past the agreed upon time to leave, and i have told him not to party down there (Which he won't stop doing because he is a drunk) Do i have to go thru a dispossesory with him, or because he is not on the lease, and since i have warned him, can i just call the cops and say he is tresspassing? --66.0.xxx.x

I dont think tresspassing will work, since you knew he has a short term occupancy. Was anything in writing about him staying there short term? Is there anything in your lease about guest? --74.243.xx.xx

There was nothing in writing about him staying short term. The lease does say that any guests that she has need to be cleared with me if it exceeds 5 or more days. --66.0.xxx.x

Then she is breaking the lease, though guest are sometimes hard to prove. I'd send her a cure or quit notice. And then if he doesn't move , procedd with eviction. --74.243.xx.xx

Even with a lease the basement of your own home shouldn't fall under the normal LL:tenant laws and rules.

Check with your local sheriff and try to file criminal trespassing charges and have him arrested. --96.234.xxx.xxx

he has to go or they both have to go.its up to her.if he doesnt leave evict her and add "et al" to the paperwork.i think u should put in rental agreements no guests over 3 days and no guests without landlords prior agreement. --208.58.x.xx
