State Specific Question About: KENTUCKY (KY)

I have a few past tenants that have moved and left owing me more money than I can get in small claims (1,500.00). How would I go about getting an amount as high as $4,000.00 owed in back rent and damages?

You have to take it to a higher court than small claims...since you do not appear to be knowledgeable on the process...time to hire an attorney to help...which I think you could add the attorney fees to the case...

But consider if this ex-tenant has the income and ways and means to pay if you get a judgment...if they are non-collectible and broke , then you might be wasting your time and money in attempts to collect. --71.168.xx.xx

In the past, our small claims court had a $1000 limit. Once I actually filed four different cases against a former tenant, each for a different issue, because I wanted to stay in small claims court. I got four different judgments. However, I wasn't able to collect on any as the wife quit her job and the husband retired and had a pension that couldn't be touched.

You could do one case for damages and another for rent if you want to stay in small claims. Many persons aren't collectible anyway. --205.188.xxx.xx

I guess i should check to see if the past tenant is employed or not. I do know where they are living now and I also have a friend that is a sheriffe who could probable find them. Thanks --74.130.xxx.xx

Carolyne - did you know where they bank? If you can find their bank and give them the judgement on or around the time the pension is deposited... you might recoup something. --99.22.xx.xxx
