State Specific Question About: CONNECTICUT (CT)

What is the law regarding security deposits. I have a tenent that never signed a lease, gave me a security deposit, and a verbal understanding that it would be a month to month situation with a 30 day notice if he were to move. He just told me on 2-9-09 that he woud be moving at the end of the month which is in 19 days. Do I have a right if I can not rent the room in such a short time to with hold some of his security deposit?

How long they have otherwise been a reliable, rent paying, non-damaging tenant is directly proportional to how tolerant I'll be with things like this. Ya know?

I'm not sure what you're rights are if you just have a verbal agreement.

That was a gamble that you took and it looks like you lost (but not too badly)

At this point, I would just concentrate on trying to rent the unit ASAP.

He moved in 5 months ago. He told me he would be staying until the end of May.(Collage Professor) He understood he would be sharing a bathroom with 1 other tenant. He did this for a few months than I lost the other tenant for a few months. Now that I have taken in another tenant he feels he doesn't want to share a bathroom so he is leaving for that reason. I feel a bit upset because I fully expected him to stay through May like he originally told me. --66.232.xxx.xxx

I think for the next tenant you should write up at the very least a simple agreement that you both sign.

I have to confess that the tenant who is vacating one of my rentals has had no lease, or written agreement for the 2 1/2 years he's been there. And I have no written agreement with the parking spot tenant, either. I guess I should take my own advice and change that. --70.21.xxx.xx

This is a room rental not the whole unit? You need to research rental agreement for a room, and consult the police regarding rooming house procedures - different than apartment or SFH. --99.147.xx.xx

In CT, you have a month to month tenancy. In the absence of a written agreement the term is determined by the amount of time between rental payments. If your tenant pays monthly, he is a month to month tenant.

The tenancy is governed by Connecticut Landlord Tenant laws.

Connecticut requires one month (full rental period) notice to terminate a month to month tenancy.

Your tenant's notice on February 9, 2009 would not go into effect until March 1st and leave the tenant liable for rent through the entire month of March.

You can deduct any rent owed through the termination period from the Security Deposit.

If you find a tenant to move in prior to March 31st, you deduct the prorated rent for the number of days the place was vacant.

If your tenant wanted to move out on February 28th, then he would have had to give notice on or before February 1st.
