State Specific Question About: MISSOURI (MO)

Besides going into a suit, any advice on getting tenants to honor their lease term and not deciding to move out early after giving me a 30 day notice? obviously their security deposit won't cover the remainder of the term, and secondly there wouldn't be anything to cover damages if the security deposit is used. --70.43.xxx.xx

This will depend entirely on what their reason for wanting to break the lease might be. Usually it is related to money or sex (job offer or new gf/bf) and there isn't much to be done about that.

But if this is happening to you a lot... I'd begin to wonder if their reason may have more to do with YOU rather than them. --71.166.xxx.xxx

It is fairly hard to keep someone from moving that wants to.

At lease signing, I emphasize at great length about the tenant being liable for rent throughout the lease. Of course, I am required to try to mitigate the damages.

When someone does move out early, point out that it is to their advantage to be cooperative about your showing the unit and to help you find a new tenant in order to reduce their liability.

I rarely have anyone move out early, but when they do usually it is because their financial situation is changed and they can't afford the rent. In that case, I am just as glad they have moved out. --82.224.xx.xx

Good advice from Mr. R and Carolyn, as usual.

The only thing I'll add is something I tried recently with a tenant who had been a year lease but went on M2M when she wanted to buy a house. I usually let a person do this if they've been good tenants for a year's time. Anyway, she left me a voice mail at 11:30 PM on Nov 30th that she had moved out the previous day because her new house deal had finally gone thru. It had been postponed due to loan issues once before, and I hadn't heard anything else since. So, I got a negative one day notice!

After calmly explaining to her that she was required to give 30 days ADVANCE WRITTEN notice, I told her I would try to work with her situation. She just bought the house so of course she didn't have any money (grins). We worked out a deal where she pays me $100 every two weeks until her balance is paid in full. Also, I used up the remainder of her security deposit toward covering my cleaning and re-rent expenses. She's paid three payments so far, and still owes $124. However, she's been prompt and I believe she will fulfill the obligation. Nice gal, just didn't understand the concept of giving proper notice. --204.80.xxx.xx

i would say if they want to break the lease in winter they owe me two months.if they break it and dont pay this i would sue them for my losses.breaking a contract can be expensive.i just do mtm anyway so its 1 rental period notice and off they go. --208.58.x.xx

What's wrong with you mitigating damages by advertising and suing them? Do whatever it takes to get paid! Do NOT allow them to use the s.d. as last month's rent etc.

File for eviction, get a judgment, collect with the judgment. Don't mess about, be tough like an ingrown toenail! --78.42.xxx.xx
