State Specific Question About: MISSOURI (MO)

Tomorrow I'm going to court with my attorney for my first Rent and Possession eviction (I'm using Lowther Johnson as Sid recommended).

Questions:

1) How soon after I receive a favorable judgment will the tenants be legally allowed to stay in my rental?

2) If the tenants stay beyond the eviction leave-date (during the unlawful detainer period), am I allowed to enter the premises without giving notice to them?

These are all questions for your attorney.

For what its worth, I would NEVER enter property whose tenants were being evicted. There's too much potential for drama...

I went to court on 12/15. Renters were given 7 days to leave. If they did not, the sheriff would take over. --4.252.xx.xxx

In Jackson Co (Kansas City), the judgment sits on the Judge's desk for 10 days (the appeal period) before it is sent on to the Sheriff, who will then, after a few days, go out and post the property, giving the tenants a few more days. If the tenants are still there on court date, you should file for restitution on your way out of the courthouse, or you are on your own, with nothing but a judgment (an invoice signed by the judge, as we like to call it)

I am in Jackson County, as is Martin. As he said, in Missouri there is a ten day period after the judgment is awarded for a tenant to appeal. Nothing happens during that timel. However, go ahead and file for restitution when you are down at the court house - and after ten days the judge will add it to his pile to look at. Then notice is service at the property, giving the tenant a few days to get out. If they don't (which often is the case), then you arrange a time with the sheriff's office.

I have had things take months in the past, but I think it is a little faster now.

And do not enter the property without notice when the tenant is still there.! --82.224.xx.xx
