I can't really answer that, as I've never had a late fee challenged in court.

The general rule I use is, the late fees should double the rent. If you rent for 900/m, the late fee would be $30/day. We cannot charge late fees in SC until the 6th, but we are allowed to offer an early payment discount... and make it equal to the late fee.
