I am in a procees of evicting one of my tenants, if he offers to pay half of the money due and pay the rest later, should I refuse it or proceed with eviction anyway?

I assume the half is for the rent+late+lawyer+court fees, right? In some states a partial stops the process, check your state laws before you deposit - you may be able to accept and take to court for judge to decide, you could ask someone at the courthouse but they may not be obligated to answer. --99.160.xx.xx |

I was in this exact spot several years ago and I called my State Office of Consumer Affairs and asked them. They told I could, as long as I sent "a notice of acceptance with reservation". You may want to try asking your State.

You can take partial payments BEFORE the eviction process begins. You should begin the eviction process TODAY; it's still a non-payment of rent. Not to do so would show partial payments are allowed. You can accept $$$ and proceed with the eviction as long as your Notice To Quit includes this disclaimer:
ANY MONIES TENDERED AND ACCEPTED AFTER
THE DATE OF SERVICE OF THIS NOTICE SHALL
BE FOR USE AND OCCUPANCY ONLY.

BE FOR USE AND OCCUPANCY ONLY) is it something you write on the space provided in the notice to quit form .As you probably know this form is provided by the court and there is no such disclosure already written on.
