State Specific Question About: NORTH CAROLINA (NC)

My tennants broke up. He stayed and girlfriend left. Our contract was for each one of them. Should I hold her responsible for 1/2 the rent until the lease is up? --98.67.xx.xxx

(a) JOINT AND SEVERAL TENANCY: If more than one person signs this lease as a Tenant, their obligations are joint and several. Do you remember when you qualified them if he made enough to cover the rent himself. He might be able to pay it on his own. Any new tenant needs to go through checks and qualify. Otherwise if he pays the rent and on time there's nothing to worry about, if he doesn't then when you evict, you put whom ever is on the lease on the paperwork, in this case both of them. --167.6.xxx.xx

Tenants' personal lives are none of your concern. Rent paid on time, each month, IS your concern. If the one remaining in residence cannot afford, he can move out and pay you the damages allowed by lease/state law, usually equal to rent plus costs of cleaning and re-renting until unit is filled.

Hold them both liable for the full rent due and collect from whichever one you can get. And be sure to get the phrase "jointly and severally liable for all rents, fees, and money due under this lease" added to your rental agreement if not included already. --204.80.xxx.xx
