State Specific Question About: MISSOURI (MO)

I am a landlord with a tenant who has no lease but has been renting out my studio for about two years. She lost her job about 6 months ago and has not paid rent in 4 months now. She paid about $150 in small payments but is still in the apartment promising to pay the full amount due. She has offered to move out in two weeks but I don't think she will. I would like to have an eviction letter ready in case she changes her mind in two weeks and decides to stay another month for free. Since she has no lease, she rents month to month.

Do I have to hire a lawyer or is there a form eviction letter that I can give her and copy a lawyer in case she does not move out? --70.245.xxx.xxx

I wouldn't wait to weeks to give her a notice to quit. Give her the letter ASAP. So in 2 weeks you can go straight to the court house to file.

Honestly I wouldnt be so nice, I would give her 3 days notice and go file in the 3 days. Push come to shove if she really does pay in the 2 weeks you can always settle the case but at least you have a fall back in the works if she doesn't. Also filling will put it on her eviction report where it should be so the next landlord will now she is a PITA too. --67.85.xxx.xxx

Serve the Pay or Quit immediately! Begin the eviction process now. She will not leave until you get her out. Read your state laws regarding evictions. Go to the courthouse and observe an eviction hearing. Call a lawyer for help the first time around.

Missouri does not have pay and quit notices. And you can do this without an attorney since it appears to be a straightforward situation.

What county are you in?

Since she owes you rent, you file a landlords petition, which is rent and possession. You could do that today if you wanted, but check since some offices might close early for holidy time. However, there are filing costs. Many counties have one of the forms on line. Jackson County has a sample. I will post that link in the next post, in case your county doesn't have one. You would just change the minor things to have it fit your county.

She must be served, which often is hard to do. If you fill out the extra form to have it "posted", there is an attempt to serve and if that doesn't work it is posted. You can get possession if it is posted but not served, but not a money judgment. However, you can go back for the money later with a small claims action. --205.188.xxx.xxx

i start eviction on the 5th and think u should too if your state lets u.DO NOT DELAY IN THESE MATTERS.if u havent evicted before u might want to contact a landlord tenant atty.maybe someone can give u a name or maybe u have a friend in the biz who can give u a name or see yellow pages and "attorneys" or get with a landlord group in your hood. --208.58.x.xx
