State Specific Question About: ARIZONA (AZ)

My brother is the executor of my mothers estate I want to save one of the properties from going into foreclosure he has no more interest in the property he has already lost12 properties, how can I transfer it and take title in my name? Please help,thanks. John. --71.2.xx.xx

You need to petition the orphans court to intervene to possibly remove him as executor and name someone else. As executor (here) he would require a bond to protect the other interested parties from wasting of assets and other malfeasance.

This is a civil law issue that only touches on RE and needs to be dealt with NOW. I'm in the middle of a similar situation now (no waste of assets but to substitute executor/trustee)

As I understand it, an executor deals with the wishes of the deceased and assists with the dispersal of assets according to their will, or if intestate, with probate. Was you mother intestate? Were you named as a beneficiary, or were you omitted in her last wishes? --71.206.xx.xx
