State Specific Question About: ARIZONA (AZ)
Hey folks! Quick question, crack head tennant said last Friday she was moving out this week. Didnt pay on Dec. 1st (mon) so on Tue I posted 5 day notice to pay. Cant go back to court to file till 10th, but my question is, if shes moved out can I go in an get the place cleaned up? It's a MESS!! I doubt she is going to return keys and clean it up, so I guess im wondering why I have to wait 20 days or however long the court process takes to re enter and get started?

If you think she has actually moved, post a Notice of Abandonment if your state allows that.

Offer her $20 cash for the keys if you have her cell# - don't they all have cells even if they don't pay rent? If she truly is a crackhead she'll take it and you can start shoveling out the hovel she made of your property that much quicker.

Gary, how does the outside of the home look? When a pending eviction is taking place, at a minimum I start getting the outside looking rent-ready so that I can start advertising. I've never had a problem with fixing up the outside of a home, while leaving items inside alone till I can get the keys from the resident or legal possession.
It's amazing how many landlords will wait until the very last moment before at least making sure the outside of the home is presentable to those who may just happen to pass by because they saw the house advertised on Craigslist. --205.188.xxx.xxx |

Just to be clear, when starting measures to get the "outside" rent-ready, I was only talking about doing so when the property appeared to be abandoned, but you have not yet gotten legal possession. Check abandonment law. If you think she's gone, post and mail for 5-days, and if no response, then 10 days you can retake the unit and store her stuff. But only if her stuff is there.
If no stuff, and empty, the 5-day rule applys.
