State Specific Question About: MISSOURI (MO)

New landlord here. My two tenants are a married couple who have paid late on rent in both months of their tenancy. I messed up when I only did a criminal background check on them for our county. While doodling around the other day, I found where there exists a recent warrant for their arrest in another Missouri county, for what looks like failure to show up to a probation hearing (I don't know the original offenses). They both have a long rap sheet in that county.

Questions:

1) This couple has a young child. Is there any law prohibiting eviction of a family during the winter in MO?

2) Is it necessary to have a valid reason to evict?

3) My goal is to rid myself of these tenants. Would it be better to evict them (if possible), or rather inform law enforcement of their whereabouts?

1 evictions can be executed any time of the year and without regard to children or the elderly.

2. If you have a yearly lease then - yes you do need a reason to file the eviction. If they are late on rent, you can file rent and possession immediately for eviction. You should give them verbal or written notice that they are late and that the eviciton is being filed. Have a lawyer do it for you. If in St Louis area, try Alan Baker. If they are in some other way violating the lease, then file unlawful detainer. Hopefully, your lease includes late fees. if so, collect them

3. i would not notify the law. It may appear as a form of harrassment during the upcoming eviction.

Chances are they'll get pulled over for doing something stupid on the road. At which point the law will know where they are. If you inform the police where they are, and they are taken to jail, 1. you will have to evict them while they are in jail. 2. Be prepared to fix your front door. 3. be prepared to fix the damage they do to your apartment after they find out it was you that turned them in, and then they got out on bail and then Hey, let's get the so&so back!

Now, chances are they will pay rent late again. Just serve your notices and either do a cash for keys or evict them. --64.255.xxx.xx

Red - I would not tell the Police for the reasons Elia gave above. I dont think the police will do anything if you did tell them. they have too much going on already. how late are they for both months?a turnover can cost u 5 k before u are thru and next guys wont be perfect either.robinson says "if they pay they stay" and thats the approach i would take.u may very well end up tossing them later.but they could work out. --208.58.x.xx

And, in MO, you have to demand the rent, but not even in writing! AND you can file the minute they do not have it. DO THAT. Get the bums OUT!

Stay out of their warrant issues. Let the pros handle that. It's not your job. You're not trained.

Don't know how, but they'll find out it was you. You are the ONLY one with something to lose (rent, delays, smashed walls, slit tires...)

Failure to Appear is a very minor offense. Locally, a phone call from them to the court is sufficient to cancel the warrant.
