State Specific Question About: OREGON (OR)
mobile home park tenant has a truck that leaks oil all over the ground,and has been asked to fix--over and over.It is now worse than ever and his solution is to put a small refrigerator door on the ground to catch the oil.Isn't there something in landlord tenant law or state DEQ laws regarding this? Also where do you think he dumps the oil that doesn't go on the ground?? --71.36.xxx.xx |

Call DEQ. You can have him fined for dumping oil.

According to the Florida Statute Chapter 83.56, If there is a continuing noncompliance within 12 months of a written warning by the landlord, deliver a written notice specifying noncompliance and landlords intent to terminate rental agreement. Example of noncompliance: destruction, damage or misuse of landlord propety , the landlord may terminate rental agreement, and the tnenat shall have 7 days from the date that the notice is delivered to vacate the premises.
The notice shall be adequate in the following form:
You are advised that your lease is terminated effective immediately. You shall have 7 days from delivery of this letter to vacate the premises. This action is taken because____________.
I left a note like this on a tenants door due to they were smoking in apartment and it wasnt allowed. They never did it again.

I thought leaking oil from trucks was required of mobile home park tenants...
If you aren't prepared to evict them (and the 10 others doing similar) don't expect it to change.
(don't expect it to change after you evict either tho)

I have a tenant's boyfriend car doing the same thing.
I have asked repeatedly that he clean it up with cat litter. He does not do it and just smiles and acts all too friendly.
Hopefully this building will be sold after the New Year. For yours, give him notice before it becomes a serious oil spill and the DEP comes after you. --76.99.xxx.xx |

Give him written notice to comply. He is probably breaking some enviromental law in your county and county will come after you to fix.
If he doesn't comply, evict, if you can.

Do not call DEQ. If for some reason they determine the property is an environmental hazard you will pay for the testing, removal and remediation of the earth. Stay away from any govt agency.

This is serious - guess who ends up getting fined and ordered to clean up the land? I have friends who do audits for oil companies world wide. This better be stopped right now! Even selling might not be the answer as you would need to disclose the environmental HAZARD.
One drop of oil pullutes a lot of ground water.

a rubber rug or folded cardboard box might help before there is oil everywhere.a colleague used dawn dishwasher detergent to clean this.its work!i havent had much luck with this problem.hard to get the stuff out. --208.58.x.xx |
