I am on the other side of the state, so I don't know St. Louis area attorneys.
However, it would help those in that area if you could be a little more specific.
It sounds as though you own the properties but are having trouble making payments and want to let them go into foreclosure. If that isn't the case, please clarify. --64.12.xxx.xxx |

Carolyn, yes you are correct. Interest rates are ARMS and keep adjusting up. We are draining our savings to keep up with the payments. We're upside down on these properties, so can't refi. Realize that the ARMs were a bad move 4 years ago, but live and learn. Want to discuss options with a pro. Realize credit will take a huge hit, but want to rid of these properties without throwing away all of our savings to keep up the mortgages. Want to avoid a deficiency judgement by lender b/c we do have some savings. Some web sites say no deficiency judements allowed in MO. Other sites say that deficiency judgements can be pursued. Shell, there are two are three real estate associations listed on our national association directory. I would suggest that you attend one of their upcoming meetings. The meetings would be an excellent resource to network and learn of a good real estate attorney in the area. You can get recommendations from other landlords, and there is a chance that an attorney may actually be present at the meeting. You may also get to talking with other landlords who has faced a similar situation to yours.
To get info on the local associations, go to the home page of this site, scroll down the left hand index and click "Find An Association". There you will see our national association directory, listed by states. --64.12.xxx.xxx |

I used a local Real Estate attorney Richard Abrams to draft my lease and notices, but that is the only interaction Ive had with him. His # is 314-721-5156.

We're in the same boat with one of our properties and would like some feedback. It's for sale, no buyers in this market, and the tenant is being evicted for non-payment. What are the ramifications to sending the mortgage co. the keys and walking away (other than the credit hit)?
