State Specific Question About: WASHINGTON (WA)

I would like to have a stamp made to stamp the back of the check when returning the Tenants Security/Damage Deposit, I have forgot the proper legal wording but I believe it goes something like... By cashing I reliquish all recouse and except as full payment...

All input will be appreciated.

If you believe you need a stamp for this then I'd suggest that perhaps you need a better class of tenant, or at least a better lease, and application process, and turnover process.

Michael, just because you have a stamp that says that, I hope you are aware that while some residents may accept it and not challenge you, that the wording on the back of the check may not be enforceable if a resident actually wanted to pursue their legal rights. --64.12.xxx.xxx

I had a tenant once put something like that on a check made out to me...if I deposited it they would be 'paid in full'. My atty said that it didn't matter WHAT they wrote on their check - I could deposit it and they would still owe me back rent and damages.

This is at the bottom of my itemization statement...it's too long to put on the back of a check.

This check/statement is tendered as an offer in compromise for the settlement and return of the security deposit held on the Tenant/Payee’s tenancy. This offer does not waive, relinquish or diminish the right of the Agent or Property Owner to seek additional monies should the Tenant/Payee reject this offer in any way including but not limited to the filing any legal action with regard to Tenant/Payee’s tenancy. --64.12.xxx.xxx
